Inventions and patenting / exploitation
A change to § 42 of the German Employee Inventions Act (ArbnErfG) has been in force since the 7th of February 2002. Since then, inventions made by university professors, lecturers and research assistants are no longer deemed to be free inventions, but are instead treated as employees' inventions and must be reported to the university.
Employees' inventions in this context are inventions made by the University of Wuppertal employees in the course of the performance of service under contract of employment or else are based on know-how and activities (including secondary employment and research carried out on behalf of third parties) acquired in the course of carrying out such work at the university.
Because universities in North Rhine-Westphalia lack the resources to process invention reports, the German Federal Ministry of Education and Research (BMBF) instigated the establishment of so-called Patent Exploitation Agencies (PVA). Their remit is to evaluate the patentability of a given invention and to deal with its potential subsequent exploitation.
The company PROvendis GmbH, a patent marketing agency for the universities of North Rhine-Westphalia, is responsible for the performance of these tasks.
